Home Curiosity Terms and Conditions

1. This agreement is a legal document which sets out your rights and obligations and those of Home Curiosity. co.uk , ( “Home Curiosity”, “we”, or “us” ), in relation to this site and the services offered by Home Curiosity through this site.

2. By registering you are thereafter deemed to be a member of the Home Curiosity site and accept that you are entering into a contract with us on the terms of this agreement. The Agreement also applies to visitors to the Home Curiosity site on each and every occasion who do not register to become members of the Home Curiosity site. This Agreement also includes Home Curiosity’s  Privacy Policy and by agreeing to this Agreement you also give your consent to the way we treat personal data as described in that policy.

3. When you register on the Home Curiosity site you must use your correct name and address. You must also supply your correct e-mail address. During the registration process you will be sent an e-mail from Home Curiosity to allow us to ascertain that the email address you have supplied is controlled by you. To assess this, the e-mail contains simple instructions which you must complete.

4. In registering with Home Curiosity, you undertake to ensure that information conveyed to us in registration is current and accurate. Any changes to these details e.g. name, address and e-mail must be notified to Home Curiosity through the  Contact Us facility on the Home Page.

5. Home Curiosity site uses:

1. Non-registered visitors (i.e non-members who are still nonetheless bound by this agreement) are able to :
   1. Conduct a search for addresses of properties previously uploaded to the Home Curiosity site and thereafter view images of the retrieved properties.
   2. A non-member can send an email to friends inviting them to register or visit the site.
2. Members (i.e visitors who have registered with the site) are able to
   1. Provide an address and photographs of properties which they currently live in or have previously lived in. The addresses and photographs will appear on the Home Curiosity site for other visitors to search and view.
   2. Edit or delete properties at 5.2.1 above
   3. Partake of all the services available to non-members (see 5.1.1,  5.1.2 above).

6. The Home Curiosity service must only be used by its members and non-registered users for the purpose set out at clause 5 above. Members and non-members therefore must not

1. use access to the Home Curiosity site and information available from it for the sending and receiving of unsolicited bulk direct mail
2. place material on, or otherwise use the Home Curiosity service for any commercial or business service.

7. Home Curiosity reserves the right to withdraw or modify some features or the entirety of the Home Curiosity service where there are commercial or legal reasons for doing so. Please note that we are not an internet service provider. To successfully use the Home Curiosity site you must have internet access and all the necessary skills and software required to use the internet and to send and receive e-mail

8. If the Home Curiosity site becomes inaccessible as a result of technicalities we will use reasonable skill and care to overcome these and resume normal service as soon as reasonably practicable, if the said technicalities are within our control.

9. You, whether you are a member or non-registered user acknowledge that we are not and cannot be responsible for the behaviour of our members, either on this site or elsewhere. We merely provide a venue at which to access the Home Curiosity service. We can in no way guarantee that material, in particular, images, contributed by members have all been screened although we will make every effort to regularly undertake spot checks of images uploaded to the site.

10. You are responsible for ensuring that no material you upload or is uploaded through a machine on which you access Home Curiosity, nor any communication you make in connection with any Home Curiosity service is capable of i) infringing intellectual property of other rights of any person/ legal personality, ii) is contrary to criminal or civil law, iii) is offensive, threatening, abusive, insulting, obscene, defamatory or misleading.

11. Home Curiosity has no control over or responsibility for the accuracy of the images and the properties they represent uploaded to the site by members. Likewise, if third party sites are linked to from the Home Curiosity site we are not endorsing nor are responsible for anything represented on the said third party site.

12. Any user of the site who encounters material which appears to be contrary to this Agreement should notify us using the Contact Us  facility available on the site.

13. If a member acts in breach of this agreement or uploads material in breach of this agreement Home Curiosity reserves the right to i) suspend or terminate members’ access to all or part of the site and/or ii) to remove or compel the member to remove the said material. However, please understand that we cannot guarantee to prevent terminated members from re-accessing Home Curiosity.

14. If a members’ access has been suspended or terminated they must not re-register or re-access the Home Curiosity site unless they obtain the consent of Home Curiosity. This can be sought by emailing us. Use of the Home Curiosity site through your email while you are logged on is entirely your responsibility.

15. It is the decision of Home Curiosity which determines whether the material placed on the Home Curiosity site infringes this Agreement. It is therefore at our discretion whether we remove or compel the member to remove the said material. If a site user has conveyed concern to us regarding the content of material ( especially images) on the site, Home Curiosity undertakes to make an assessment of the material as soon as reasonably practicable to determine if it infringes this Agreement. If it does so infringe this Agreement we undertake to act as detailed in clause 13 as soon as reasonably practicable.

16. If Home Curiosity or its affiliates offer new services they may be subject to a new and/or additional terms and conditions or rules. Any failure by you to comply with these terms and conditions or rules which govern new services will constitute a breach of this agreement and therefore may result in termination of this agreement with you.

17. We may introduce new services in the future which could require payment of a fee either to us or a third party or we may introduce a fee for existing services on the Home Curiosity site for which no fee previously existed. These terms will be conveyed to you via e-mail prior to implementation to allow you opportunity to continue participation in Home Curiosity or not.

18. You use Home Curiosity entirely at your own risk and therefore you release Home Curiosity, (insofar as allowed by law) in connection with your use of Home Curiosity, and material included by members and third parties arising out of use of any third party sites and arising out of disputes with other members.

19. ALL intellectual property rights in and relating to Home Curiosity including relating to the material contributed by members are owned by Home Curiosity. No-one may copy, distribute, show in public or create derivative work from Home Curiosity unless properly licensed to do so by Home Curiosity. In submitting material to Home Curiosity you imply you have legal entitlement in terms of intellectual property to do so. Thereafter you grant Home Curiosity a non-exclusive, royalty free, non-terminable licence to copy, modify and distribute in any way derivative works from that material.

20. We shall not be liable to you or third parties for any loss (excluding arising from personal injury) whatsoever not reasonably foreseeable by us whether arising out of any negligence or breach of the Agreement or otherwise. If matters beyond Home Curiosity’s control do not allow us to perform obligations pursuant to this Agreement we will not incur liability. You agree to indemnify us against all liabilities, claims and expenses that may result from any breach of this Agreement.

21. We have a right to assign or subcontract this Agreement in part or in whole. You cannot do this unless you obtain the express written consent of Home Curiosity. We also reserve the right to alter the terms of the Agreement, changes taking effect as soon as we place a notice to alert you to the said changes on the Home Page of Home Curiosity.

22. This Agreement is to be governed by the law of England and Wales. If, under such law any individual term of the Agreement is deemed to be unlawful or unenforceable, the remainder of the Agreement will nonetheless remain valid.
